Syntext, Inc. GPL License Exception for Syntext Serna Free Edition Version 1.0 Additional rights granted beyond the GPL (the "Exception"). As a special exception to the terms and conditions of GPL version 2.0 or GPL version 3.0, Syntext, Inc. hereby grants you the rights described below, provided you agree to the terms and conditions in this Exception, including its obligations and restrictions on use. Nothing in this Exception gives you or anyone else the right to change the licensing terms of the Syntext Serna Free Editon. 1) Definitions "FOSS Application" means a free and open source software application distributed subject to a license listed in the section below titled "FOSS License List." "Licensed Software" shall refer to the software licensed under the GPL version 2.0 or GPL version 3.0 and this exception. "Derivative Work" means a derivative work, as defined under applicable copyright law, formed entirely from the Licensed Software and one or more FOSS Applications. "Independent Work" means portions of the Derivative Work that are not derived from the Licensed Software and can reasonably be considered independent and separate works. 2) The right to use open source licenses not compatible with the GNU General Public License version 2.0 or GNU General Public License version 3.0: You may distribute Derivative Work in object code or executable form, provided that: A) You distribute Independent Works subject to a license listed in the section 4 below, titled "FOSS License List"; and B) You obey the GPL in all respects for the Licensed Software and all portions (including modifications and extensions) of the Licensed Software included in the Derivative Work (provided that this condition does not apply to Independent Works); C) You must, on request, make a complete package including the complete source code of Derivative Work (as defined in the GNU General Public License version 2, section 3, but excluding anything excluded by the special exception in the same section) available to Syntext, Inc. under the same license as that granted to other recipients of the source code of Derivative Work; and D) Your or any other contributor's rights to: i) distribute the source code of Derivative Work to anyone for any purpose; and ii) publicly discuss the development project for Derivative Work and its goals in any form and in any forum are not prohibited by any legal instrument, including but not limited to contracts, non-disclosure agreements, and employee contracts. 3) Syntext, Inc. reserves all rights not expressly granted in these terms and conditions. If all of the above conditions are not met, then this FOSS License Exception does not apply to you or your Derivative Work.
